Information on the new immigration law – 05/10/2020

On 05/10/2020, the council of ministers approved a new migration law.

This is what the law provides:

Reintroduction of humanitarian protection now called special protection

It will last two years and it will be possible to convert it into a work permit (previously it was one year and not convertible)

In addition to the previous requirements, this colud be granted:

those who if expelled, would suffer torture, inhuman and degrading treatment and violations of fundamental rights;
the recognition of the importance of the path of social inclusion, in order to strengthen the protection of private and family life.
asylum seekers will be allowed to apply for residence, in line with what established by the Constitutional Court, also when ythey only have the receipt of their asylum application;

The law also ruled about the receptio system by:

reintroducing the reception for asylum seekers and holders of special protection within second reception system (ex SPRAR), but with different access to serivces
attempting to establish programmes to foster the social and esconomic inclusion of holders of protection, also after the end of their period within reception centres
the penalties for rescue ships not complying with orders are set to a minimum of 10.000 euros to a maximum of 50.000 euros of fines and to a maximum of two years of jail;
the maximum period allowed for detention is reduced from 180 days to 90 days, which can be increased of 30 days in presence of repatriation deals with the country of origin of those detained;
those who are considered responsible for crimes against people or objects within detention center can be arrested within 48 hours, using as evidence video footage
waiting times for citizenship applications are reduced form 4 to 3 years (before Salvini decrees they were 2 years).
